TRACKING THE MONEY THROUGH JOHN BOEHNER'S PAY FOR PLAY "BOEHNER FOR SPEAKER COMMITTEE" - FINDING THE FAT CATS HOLDING UP THE MIDDLE CLASS TAX CUT

John Boehner's pay for play scheme called "Boehner for Speaker Committee" has largely flown under the radar as Campaign 2010 was deluged in a flood of dark money. Boehner advertised access to his office in return for contributions to this committee. The more you give grants you increased access. That fits the classic definition of pay for play.

Tracking down Boehner's infamous group isn't as easy as going to the Center for Responsive Politics' OpenSecrets.org and typing the fundraising group into a search bar. The Federal Elections Commission site was, predictably, less useful. But if you've got a little bloodhound in you and keep searching it can be found.

At OpenSecrets.org I isolated Political Party Committees, then just those of the Republican variety before Boehner for Speaker Committee was listed. When that link was clicked it took me to another page concisely telling me this was an Affiliated Committee with a dollar total of $3,419,111. The detail was revealed by clicking the hyper-link.

The Boehner for Speaker Committee raised $3,419,111and spent $2,833,129. It began with no cash on hand and ended up with $585,981cash on hand. This group shows no debt.

In a glaring error this report shows that the Boehner for Speaker Committee gave no money to candidates for federal office.

In keeping with Campaign 2010's tawdry image of non-disclosed donors this committee did not disclose who gave them the $3.4 million in exchange for varying levels of access to the next Speaker of the House. Those names can be found by reading the quarterly reports.


A link at the bottom takes you to the FEC site showing the original documents. The April 2010 quarterly statement showed the Boehner for Speaker Committee at a standstill having raised no money.

The July quarterly report showed the committee had moved from Ohio to a basement unit on Pennsylvania Avenue in D.C. Money started flowing as well. The report shows that $570,300.00 was raised and $431899.99 was spent. $138400.01 remained as cash on hand.

The donors represent a who's who list of fat cats for whom Boehner and the Republicans are fighting to extend the FAT CAT TAX BOONDOGGLE. Here are some of the FAT CATS and what they did to influence politics in Campaign 2010.

James Akers of Middletown, Ohio who gave $1,000 to the Boehner for Speaker Committee. In Campaign 2010 he also gave $9,800 to the National Republican Congressional Committee; $5,000 to the Republican Party of Ohio' $2,400 to Ronald E Hood, an unsuccessful Republican candidate for Congress from Ohio's 18 District; $4,800 to Rob Portman, the former Republican Representative to Congress and current Senator-elect from Ohio; $4,500 to John Boehner; and $2,400 to the once and future Republican Representative from Ohio's 1st, Steve Chabot. Mr. Akers of Middletown, Ohio coughed up $29,900 to Republicans for Campaign 2010, he qualifies as a FAT CAT .

Lindsey Matthews Blaise, a homemaker from The Villages, Florida. OpenSecrets.org reports that Blaise gave $30,400 to the National Republican Congressional Committee and $5,000 to the Freedom Project, a John Boehner Leadership PAC. Apparently the data didn't get sorted well enough to show this person also gave $37,800 to the Boehner for Speaker Committee. Blaise qualifies as a FAT CAT for giving Republicans $73,200 for Campaign 2010.

Wayne Boich, Jr., a commodity broker, gave the Boehner for Speaker Committee $15,000. Boich is a big giver to Republicans. He gave $5,000 to the Building Our Opportunities Together (Republican) PAC; $5,000 to Boehner's Freedom Project PAC; $4,800 to Rob Portman; $2,400 to Montana Republican Representative Denny Rehberg; $12,600 to the National Republican Congressional Campaign Committee; $5,000 to the Ohio Coal Association (a PAC which gave 24% to Democrats and 74% to Republicans in Campaign 2010); $5,000 to Ohio's Future PAC, a Republican PAC; $4,800 to John Boehner; $4,800 to Republican Representative-elect Bob Gibbs of Ohio's 18th District; $4,800 to Republican Representative-elect Steve Stivers of Ohio's 15th Congressional District. Boich also gave $2,400 to Rob Portman's Democratic opponent Lee Irwin Fisher and $10,000 to Democratic Representative Tim Ryan's Penguin Pac. Boich knows how to hedge his bets. Boich's $81,600 in political contributions makes him a FAT CAT.

Harper Boone, also of The Villages, Florida gave the Boehner for Speaker Committee $37,800. Boone's other donations were for $5,000 to Boehner's Freedom Project; $2,400 to Boehner; $30,400 to the National Republican Congressional Campaign Committee; $4,800 to Rob Portman; $4,800 to former Republican Florida Governor turned Independent candidate for the U.S. Senate Charlie Crist; $2,400 to Republican Representative-elect Richard B. Nugent from Florida's 4th District; and $5,000 to Mitt Romney's Free and Strong PAC. Boone boosted Republican coffers by $92,600 which means he's a FAT CAT.

David Brennan of Naples, Florida gave the Boehner for Speaker Committee $12,400. Brennan also gave $10,000 to the National Republican Congressional Campaign Committee; another $3,900 to Boehner; $2,400 to Bob Gibbs; $4,800 to Rob Portman; $2,000 to incumbent Republican Representative Steven C LaTourette from Ohio's 14th District; $2,400 to incumbent Republican Representative Jean Schmidt from Ohio's 2nd District; $2,400to former Republican Representative Tom Campbell for his failed bid in the U.S. Senate race; $2,400 to James B. Renacci, the Republican Representative from Ohio's 16th District; $10,000 to the Republican Party of Ohio; and $2,400 to Florida's Republican/Tea Party Senator-elect Marco Rubio. Brennan coughed up $55,100 to prove he's a FAT CAT.

Nicholas Calio may be a fat cat's fat cat. He showed up multiple times on the OpenSecrets.org site. He's listed under the revolving door for his ties as a lobbyist for Citigroup Management Group, a lobbyist for the OB-C Group, and as having worked in the White House in Legislative and Congressional Affairs. He's also listed as a bundler. Bundlers are "people with friends in high places who, after bumping against personal contribution limits, turn to those friends, associates, and, well, anyone who's willing to give, and deliver the checks to the candidate in one big 'bundle,'" according to OpenSecrets.org. Cailo gave Boehner for Speaker $10,000. He also gave $5,000 to Boehner's Freedom Project PAC; $2,400 to Boehner; $1,000 to Kentucky Secretary of State Republican Trey Grayson, who lost the primary to Tea Party icon Rand Paul; $1,000 to former Republican forced by the Tea Party to turn Independent Alaska Senator Lisa Murkowski; 42 separate contributions of $208 totaling $8,736 to Citigroup, Inc (a PAC with which he has ties); $2,400 to Republican Senator Robert Bennett from Utah; $1,000 to Texas' Republican Senator John Cornyn; and $1,000 to South Dakota's Republican Senator John Thune. Cailo checks in at $32,536 making him a FAT CAT.

Tracy Matthews of The Villages Florida gave the Boehner for Speaker Committee $37,800. Another person, with the same address, named M'Lissa Matthews sent the National Republican Congressional Committee $30,400. Other mysteriously similar names at this residence also made remittances to Republican interests. The Huffington Post shows that Tracy Matthews gave the National Republican Congressional Committee $30,400; M'Lissa M. Morse gave $2,400 Republican Representative-elect Rich Nugent from Florida's 5th District; M'Lissa Morse gave Boehner $2,400; and Tracy Matthews gave $2,400 to Boehner. The goings on at this Florida residence may be on the up and up but this sure smells fishy. The total contributions from the Tracy & M'Lissa Matthews & Morse combo totals $105,800 making this residence a FAT CAT home.

Wait, it gets better or worse depending on your perspective. M'Lissa Morse also gave $37,800 to the Boehner for Speaker Committee. That raises the residence total to $143,600. Now inquiring minds want to know if H. Gary Morse resides with Tracy Matthews and M'Lissa Morse since the address he gave appears to be for his company, The Villages of Lake Sumter. H. Gary Morse chipped in $37,800 to the Boehner for Speaker Committee. Did that household total just go to $181,400?

The Morse parade just keeps on giving. Next up is Mark Morse, giving the corporate address and giving the Boehner for Speaker Committee $37,800. Then comes Renee Morse, using the same address, and sending the Boehner for Speaker Committee another $37,800. Jennifer Par further muddies up the waters by sending her $37,800 from the Village of Lake Sumter business address used by H. Gary Morse, Mark Morse, and Renee Morse. That's a lot of loot from one address.

R. J. Reynolds Executive Vice President and Attorney Tommy Payne gave the Boehner for Speaker Committee $2,500. He also gave retiring Indiana Republican Representative Steve Buyer $2,000. Buyer is retiring because of his wife's poor health; $3,800 to North Carolina Republican Senator Richard Burr; $100 to the National Republican Congressional Committee; $5,000 to Boehner's Freedom Project PAC; $2,400 to Boehner from the Tommy Payne II that is reporting as the NICONOVUM USA, INC./PRESIDENT - NIC; $4,813 bundled in 14 contributions, 11 at $346, 2 at $366 each and one for $335 to R. J. Reynolds Tobacco, apparently for its PAC; and a hedge betting contribution to Democratic AmericPAC for $5,000. The tab on Tommy Payne runs to $25,613 qualifying him for FAT CAT status.

Philip Purcell, President of Continental Investors gave the Boehner for Speaker Committee $25,000. He also gave $5,000 to the Republican Party of Illinois; $2,400 to Massachusetts' Republican Senator Scott Brown; $2,400 to Michael Halfacre, the Fair Haven, N.J. mayor who ran for Congress in a losing bid; $4,800 to new Republican Senator Mark Kirk from Illinois; $2,300 to Ethan Hastert in his losing primary bid to run for his father's former seat, Ethan is the son of the former Speaker; $7,000 to Republican Representative-elect Adam Kinzinger from Illinois' 11th Congressional District; $2,400 to Robert Dold, the Republican Representative-elect from Illinois' 10th Congressional District; $2,400 to Rob Portman; $2,400 to Randy Hultgren the Republican Representative-elect from Illinois' 11th Congressional District; and $22,600 to the National Republican Congressional Committee. Philp Purcell paid out $78,700 assuring him of FAT CAT status.

Albert and Barbara Siemer of New Albany, Ohio each gave the Boehner for Speaker Committee $37,800. Albert is the owner of DESCO Corporation a company that manufactures, among other things U.S. Navy Divers' Knives. Barbara is a community volunteer. On Albert's side of the ledger are gifts to the National Republican Congressional Committee for $30,400; Boehner's Freedom Project PAC for $5,000; $2,400 to Patrick Tiberi, the Republican Representative from Ohio's 12th Congressional District; and $10,000 to the Republican Party of Ohio. From Barbara's side, she's given $30,400 to the National Republican Congressional Committee; $5,000 to Boehner's Freedom Project PAC; and $2,650 to Patrick Tiberi. The Siemer family gave Republican interests $161,450 making them FAT CATS.

John Snow, the former Secretary of the Treasury, gave the Boehner for Speaker Committee $37,800. He also gave $10,000 to the Republican Party of Minnesota; $5,000 to Boehner's Freedom Project PAC; $4,800 to former Vice President Dan Quayle's son Ben Quayle who is now the Republican Representative-elect from Arizona's 3rd Congressional District; $4,800 to Republican Roy Blunt who is moving from representing Missouri's 7th Congressional District to the U.S. Senate; $2,400 to Rob Portman; $30,400 to the National Republican Congressional Committee; and $30,400 to the National Republican Senatorial Committee. Secretary Snow gave $125,600 earning his FAT CAT merit badge.

Amber and Justin Wilson from The Villages, Florida each gave the Boehner for Speaker Committee $37,800. Amber is a homemaker and Justin is the Sales Manager for the Villages of Lake Sumter, they are avid Republican givers. On Amber's behalf 30,400 went to the National Republican Congressional Committee; $5,000 to Boehner's Freedom Project PAC; and $2,400 to Richard B. Nugent. Justin gave $30,400 to the National Republican Congressional Committee; $5,000 to Boehner's Freedom Project PAC; another $2,400 to Boehner; and $2,400 to Richard. B. Nugent. The Wilson's gave $153,600 marking them as FAT CATS.

These FAT CATS are holding up the Middle Class Tax Cuts insisting on the FAT CAT TAX BOONDOGGLE. Shame on them.

CLOTURE NOT INVOKED ON H.R. 4853 - TWO VOTES EACH FAIL BY A SINGLE VOTE

Cloture requires a 3/5 majority of Senators present and voting to terminate debate on a bill. Saturday, Senate Republicans were able to thwart the Middle Class Tax Cut Extension by a single vote.

The votes came on two Senate Amendments, the first was on S. Amendment 4727 to H.R. 4853. This is the Amendment by Senator Baucus, and others, tying provisions of expensing depreciable assets for Small Businesses to the Patient Protection and Affordable Care Act. If this amendment passes any repeal of §10909 of the Health Care Reform law will trigger an extinction of this tax break for Small Businesses. The vote was 53 Senators for invoking cloture and 36 against. Do the math 53 + 36 = 89; 89 / 5 = 17.8; 17.8 * 3 = 53.4. 54 votes were needed to invoke cloture. The Republicans needed to yield only 1 vote to provide certainty that no one's taxes would go up and that everyone would get the Bush Era tax break on the first quarter of a million dollars of reported income.

Joe Lieberman didn't surprise me. That Joe Lieberman is permitted to caucus with the Democrats does puzzle me. But Senator Jim Webb has me puzzled. This isn't anything difficult with which the Senator from Virginia should struggle. This isn't like Don't Ask Don't Tell. This is telling the vast majority of American taxpayers that they get their tax break. Come On, Man.
Nebraska's Ben Nelson has veered back off the reservation again. I realize that his state has a lot of old people whose minds are distorted by demagoguery from FOX Fantasy. But Ben isn't leading. Ben fancies himself  a broker. The problem is every time he cuts a big deal it gets squashed. Remember the trauma he put us through on Health Care? Come On, Man.

And last but not least is West Virginia's Junior Senator Joe Manchin. For God's sake Joe, are you really going to stake out territory supporting those who spent thousands upon thousands of dollars to make sure you'd never make it to Washington?

Joe, if you think those fat cats are going to forgive and forget their monetary and political losses at your hands in Campaign 2010 by this lame gesture then you're more naive than the President thinking the Republicans are now going to start making decisions based on the best interests of the nation, rather than politics. Come On, Man,

The Next vote came on invoking cloture on S. Amendment 4728. That is an amendment proposed by Senator Schumer to modify the tax extension and extend the FAT CAT TAX BOONDOGGLE to those reporting a threshold income of $1,000,000 rather than the $250,000 limit set by the House of Representatives. The Party of No said no to this as well.

Senator Tom Harkin [D-Ia], Senator Dick Durbin [D-Il], Senator Russ Feingold [D-Wi], and Senator Jay Rockefeller [D-WV] went from yes to no on this vote. Good for them. These FAT CATS got Wall Street De-regulation over a period of years, and these tax cuts from George W. Bush. Not only did they not create jobs, they nearly sent the global economy spinning off its axis. The Middle Class Tax Cuts will cost America $1.5 trillion. Any additional borrowing to enhance the greed of the richest American taxpayers is uncalled for.

No Republicans voted to invoke cloture on either Amendment to H.R. 4853. The Republicans don't intend to compromise, they never did, they never will until the American people figure out their game and send them packing to the lands now occupied by the Whigs and the Federalists.

The Buddhist monk said everything has a beginning and everything has an ending. Now may be the beginning of the ending of the Republican Party.

The vote on the compromise amendment was 53 in favor, 37 opposed, and 10 not voting. Doing the math we see why it failed the 3/5 majority required. 53 + 37 = 90; 90 / 5 = 18; 18 * 3 = 54. Once again a Senator short.

S. 3307, H.R. 4853, WEAK REPUBLICAN ARGUMENTS, SENATE AMENDMENTS, & CLOTURE RULES


Representative Rob Andrews, [D-NJ]

Kudos to New Jersey's Democratic Representative Rob Andrews for concisely and correctly framing the issues of the day. During debate on S. 3307, from the Congressional Record:

Mr. ANDREWS. Mr. Speaker, the Senate unanimously passed this bill. Unanimously. I think I understand why, because they understood what I hope we understand today is the choice that is in front of the country. You can understand that choice by thinking about where two Americans are at this moment.

One of them is a second grader who just went through her paces and classes for the morning. It's now time for lunch. This bill says no matter how much money her mother and father make, she is going to get a nutritious, wholesome meal to fuel her for the rest of the day. And, yes, that is going to cost $4 billion, which is offset by cuts in other areas of the budget.

The second American is the leader of a huge hedge fund on Wall Street. He is on his way to lunch at the priciest restaurant in Manhattan, maybe a $200 or $300 lunch. One of the other issues before the Congress this week is whether he should get a tax cut that over the years will cost a dollar for every penny that this bill costs. These are the two Americans whose considerations are before the House today.
The Republican arguments against S. 3307 all came from House Republicans. This bill came from the Senate with unanimous approval by all Senators voting. That's not going to stop the Party of No which is about to become the Party of No Governance. House Republicans argued that the bill was too costly and that the Federal Government has no role to play in telling anyone school children have to eat nutritional meals, which are subsidized by the Federal Government.

Remember that Republicans want to borrow $700 billion over the next decade to finance the Fat Cat Tax Boondoggle and now they balk at subsidizing school lunches. 22% of our schoolchildren are hungry. The bi-partisan plan the Senate developed addresses how to get nutritious food to the kids.

What does the Congressional Budget Office say about the cost of S. 3307? Well, over the next decade is it not only not going to cost $700 billion it is projected to decrease the deficit by $12 million to $14 million. Senate 3307 is tackling two problems. It is getting nutritious food to children and it is putting the brakes on deficit spending. See, http://www.cbo.gov/cedirect.cfm?bill=s3307&cong=111.

Face it, we've got to slow the growth of deficit spending before we get anywhere close to being deficit neutral or actually tackling the debt, House Republicans are just waving the spending is evil flag and ignoring the facts. That's called demagoguery, not leadership, not governing, and it results in another vote where they demonstrate that they are willing to throw the babies out with the bathwater.

That second argument might have merit if the Federal Government did not already have an on-going program being administered through the States providing school lunches. A law or rule telling someone that they can't have junk food served at the public expense is essentially making and enforcing health policy. "Police Powers" give the States authority to regulate for the benefit of the public's health. The Federal Government does not have this authority and operates only on the grants of authority expressly made by the Constitution.

The argument loses traction because the Federal Government is not making the policy in a vacuum. If it were unconstitutional for the Federal Government to be engaged in subsidizing school lunches we would have heard about it before. The Republicans aren't arguing that, today. They're just arguing that the Federal Government shouldn't require the Federal dollars to be wisely spent by the States.

So where does the Federal Government find this authority to regulate for the health of schoolchildren? Take a look at 42 U.S.C. §1751. That's the codified declaration of policy for the school lunch program. It says: "It is declared to be the policy of Congress, as a measure of national security, to safeguard the health and well-being of the Nation's children and to encourage the domestic consumption of nutritious agricultural commodities and other food, by assisting the States, through grants-in-aid and other means, in providing an adequate supply of foods and other facilities for the establishment, maintenance, operation, and expansion of nonprofit school lunch programs.

Congress properly sees children as an essential component in national security. Protecting our children by safeguarding their health and well-being means that this nation will have future generations prepared to live full and free lives.

The Republicans, however, argue that if the States want to have their children eating high starch, high fat, and high sugar foods with little protein and less fiber, then get Uncle Sam off their backs! And these people were actually elected to Congress!

S. 3307 passed the House on roll call vote 603 by a margin of 264 to 157 with 13 Members not voting. Not all House Republicans voted against this bill. 16 Republicans broke with their leadership. Good for them.

The lady filling the office of Representative to Congress from Kansas' Second Congressional District (where I live), Lynn Jenkins, voted against school children getting nutritious lunches. Lynn Jenkins does not represent us.

Then came the second part of Representative Andrews premise, the Middle Class Tax Cuts which do not extend the Bush Era tax cuts for incomes above $250,000.

H.R. 4853 is now known as the Middle Class Tax Relief Act of 2010. When it left the Senate it was called the Airport and Airway Extension Act of 2010, Part III. John Boehner, the Speaker of the House - designate, calls it the Chicken Crap Act. I think John probably knows a lot about Chicken Crap. He's just ticked off because he can't run the clock on the 111th Congress and grind the government to a complete standstill unless he can deliver for the top 2% of America's wealthiest. Make no mistake about it, the Democrats are fighting for the first 98% of us and the Republicans are fighting hard as hell for the top 2%.

When H.R. 4853 came back to the House an amendment was added providing, among other things, that everyone, all 100% of us, filing income tax returns would get the extension of the Bush Era tax cuts on the first quarter of a million dollars of taxable income. That's not good enough for Boehner and the Party of No.

There is a hard truth Boehner, Jenkins, and the Republicans won't tell you. We have to finance all of our tax cuts. The Middle Class Tax Cuts will cost us and drive up the deficit by "$145 billion in fiscal year 2011, by $203 billion in 2012, and by $1.5 trillion over the 2011-2020 period," according to the CBO. If we added the FAT CAT TAX BOONDOGGLE to the equation then we'd be adding the additional $700 billion to that $1.5 trillion. That means the Republicans want to start off by plunging us $2.2 trillion further into the hole before agreeing to anything more. H.R. 4853 passed the House on roll call vote 604. The margin was 234 to 188. Three Republicans joined the Democrats to pass this bill and send it back to the Senate. Now Senate Republicans will have to vote to let the measure come to the floor. Will Senate Republicans cut off their noses to spite their faces? Or are they serious about governing?

If H.R. 4853 goes to the Senate floor it looks like it will be amended. So far five amendments are sitting in the Senate hopper. They were each introduced on December 2nd.

S. Amendment 4727 was introduced by Senator Max Baucus of Montana and cosponsored by Senators Rockefeller, Kerry, Carper, Stabenow, Schumer, Menendez, and Bingaman. The express purpose of S.Amend.4727 is to change the enactment date. This appears to relate to §201, INCREASED LIMITATIONS ON EXPENSING BY SMALL BUSINESSES OF CERTAIN DEPRECIABLE ASSETS. The House version, as passed, sets the date for this section "to taxable years beginning after December 31, 2011". This Senate Amendment ties this section "s if included in section 10909 of the Patient Protection and Affordable Care Act". This appears to have the effect of making the tax extensions retroactive to "taxable years beginning after December 31, 2009". This means that if Republicans try to repeal Health Care Reform, that they will shoot themselves in the foot with a tax cut extension for small businesses.

S. Amendment 4728 was introduced by Senator Schumer together with Senators Menendez and Stabenow. The express purpose of the amendment says that it is perfecting in nature. This amendment removes the airport provisions from the bill and makes it a standalone tax cut bill. This amendment is a compromise on the FAT CAT TAX BOONDOGGLE. Rather than set the threshold for everyone at $250,000, these Democratic Senators want to compromise at $1,000,000. Really? Reporting a million dollar income makes you middle class? Really!

Senate Amendment 4729 was proposed by the Majority Leader, Senator Reid. His amendment calls for a study. Senator Reid wants to have a study which includes "specific information on the impact of the delay in extending the tax cuts'' Come on Harry. If the House and Senate haven't figured out the impact of delays in extending the Bush era tax cuts then the public is right in its lack of confidence in the institution.

Senate Amendment 4730 also comes from Senator Reid, this one is in the nature of a perfecting amendment. This is an amendment to his original amendment. By now I am thinking that these piddling amendments are place holders so Senator Reid can do some parliamentary finagling.

Senate Amendment 4731is another Senator Reid amendment. Other than place holding for some future wrinkle in the law it offers no real substance.

Now a word on cloture. Cloture is the device the Senate uses to terminate debate. Current Senate Rules require a supermajority of 60 votes to terminate debate so that the bill can go to a final vote. Senate Amendments 4727 and 4728 are subject to cloture motions as of December 2nd. Under current rules cloture rules are ignored for one full day during which the Senate is sitting. These cloture motions were filed on Thursday, they were ignored on Friday. Today is Saturday, and that my friends may be why Senator Reid, with the clock running down, has the Senate sitting today.

IOWA'S STEVE KING IS FUDGING FACTS WHEN IT COMES TO PIGFORD II CLAIMS

H. R. 4783, now called the Claims Resolution Act of 2010, has been cleared to be sent to the President for his signature. When introduced it was called a bill "To accelerate the income tax benefits for charitable cash contributions for the relief of victims of the earthquake in Chile, and to extend the period from which such contributions for the relief of victims of the earthquake in Haiti may be accelerated." When it passed the Senate its new moniker was "Aamodt Litigation Settlement Act Crow Tribe Water Rights Settlement Act of 2010 Taos Pueblo Indian Water Rights Settlement Act White Mountain Apache Tribe Water Rights Quantification Act of 2010."

The Congressional Budget Office estimate on H.R. 4783 predicts that in the decade from 2011 through 2020 this bill will reduce the overall deficit by one million dollars.  The Congressional Budget office  Report on this bill is available  at http://www.cbo.gov/ftpdocs/119xx/doc11977/hr4783.pdf.

Upon passage of this bill Iowa's Republican Representative Steve King took to the floor during special speeches apparently to create sound bites for the rabid rightwing Republican propaganda machine. That would be conservative crank talk radio and FOX Fantasy.

Perusing the cable lineup I chanced upon Mr. King's rant. It was a cerebral moment of cognitive disconnect. Mr. King was foaming at the mouth over the provisions of law which expanded the opportunity for filing claims in the case originally styled Pigford v. Glickman.

Pigford was a case about racial discrimination by the USDA. in refusing to provide loans to black farmers when the Department of Agriculture provided those same kinds of loans to similarly situated white farmers.

Mr. King has clearly forgotten the facts about the bill for which he voted. The provision to expand the filing deadline for Pigford claimants was not, as King misrepresents, the result of a sneaky Bill or Amendment introduced by then Senator Obama, by himself.  You could reasonably guess that King was inferring that the black Senator from Illinois was inserting a black farmer boondoggle provision into the law.  That is an unfortunate but reasonable thing to say about King's remarks.

The provision of law to which King refers is §14012 of H.R. 6124, which became Public Law 110-246. That provision is summarized by the Congressional Research Service as "(Sec. 14012) States that: (1) any Pigford (discrimination) claimant who has not previously obtained a determination on the merits of a Pigford claim may obtain that determination in a civil action brought in the U.S. District Court for the District of Columbia filed within two years after the date of enactment of this Act; (2) the total amount of payments and debt relief is $100 million; and (3) the intent of Congress is to have this section liberally construed."

King's distortions suggest that the Obama Administration has caved in on the late filings of the Pigford II claims.  King ignores the facts.  First, late claims were not permitted on the basis of lack of notice as King suggests. Second, the late filers were required to demonstrate exigent circumstances which prevented their prior timely filing. Being displaced by a hurricane, for example, would qualify. Third, the numbers Mr. King, the numbers bring down your rant. Of the approximately 73,800 late filing Pigford II claims only 2,116 were permitted to go forward.

Back to King's claim about Obama introducing the Pigford II claims bill. Well, Steve is half right, but that is only because he deals in half truths. That bill was introduced by Iowa's Republican Senator Grassley, for himself, Mr. Obama, Mr. Biden, and Mr. Kennedy. It was called the Pigford Claims Remedy Act of 2007. In the House identical legislation was introduced by Democratic Representative Robert C. Scott of Virginia and Republican Representative Steve Chabot of Ohio. So it wasn't just Mr. Obama who was singularly pushing a vague benefit towards willy-nilly black farmer claimants under Pigford II, as King would lead us to wrongly believe.

Why did all the Representative and Senators, including Barack Obama introduce the Pigford II claims bills?  You have to go back to the Judge hearing the Pigford cases.  That's Judge Paul L. Friedman who sits on the United States District Court for the District of Columbia.  Judge Friedman expressed suprise and disappointment that the USDA was not including, in a consent decree, provisions that in the future the USDA would exert best efforts to ensure compliance with all applicable statutes and regulations prohibiting discrimination. The Congressional Research Service has published a history of the Pigford case settelements.  You can read it for yourself at http://www.nationalaglawcenter.org/assets/crs/RS20430.pdf.

The Black Farmers Association was paying attention to what Judge Friedman was saying and filed a $20.5 Billion Class Action lawsuit in September of 2004.  That suit was later dismissed for lack of standing.

On May 5, 2009 Iowa's Republican Senator Chuck Grassley and North Carolina's Democratic Senator Kay Hagan introduced S. 515. a bill to allow access to an unlimited fund at the Treasury to pay successful Pigford II claims.  A related bill, H.R. 899 was filed in the house by Alabama's Democratic Representative Arthur Davis.  Hawaii's Democratic Senator Daniel Inouye introduced Senate Amendment 3407 to H.R. 4213, the Tax Extenders Act of 2009.  That Amendment made the appropriation of $1.15 billion to settle the Pigford case.  As much as that is, it is a drop in the bucket to the $20.5 billion the class action suit sought.  H.R. 4213 became Public Law 111-205,

Now remember, the Congressional Budget Office says this bill will actually drive down direct spending by $1 million over the next decade.  It isn't all that dramatic but prooves the point that you sometimes have to spend a little to save a little.

King rambled on, ignoring the facts, about Obama's connection in making the $100 million appropriated to settle Pigford claims growing into this huge Pigford II settlement.  King should have been speaking to or about Grassley.  But then Grassley would have probably told him that the Pigford II claims ended up costing less than the class action lawsuit that eventually would have found proper parties with standing. 

Steve King's mind is a mysterious place where his imagination mixes with vitriol and facts are relegated to select recognition and use.  There should be a subset of abnormal psychology dedicated to the political propagandist and Steve King should be a case study.  We could learn about demagoguery from an in depth study of Steve King's mind.

Those Pigford II claims bills were engrafted into the Farm Bill. Steve King is from Iowa and he knows about these farm bills. That brings us back to Public Law 110-246, which was introduced into the House by Democratic Representative Collin Peterson from Minnesota as the Food, Conservation, and Energy Act of 2008. Peterson's bill went on to become the 2008 Farm Bill,

Steve King knows about the 2008 Farm Bill, Public Law 110-246. King cast his vote to pass the bill in the House on May 22, 2008 on roll call 353. That vote required a ⅔ majority and got in a margin of 306-110. The bill went on to the Senate where it was passed without Amendment on Record Vote 144.

The 2008 Farm Bill went to the White House where President George W. Bush gave it his VETO. You can read President Bush's Veto Message at http://www.gpo.gov/fdsys/pkg/CDOC-110hdoc125/pdf/CDOC-110hdoc125.pdf.

The Food, Conservation, and Energy Act of 2008 came back to Congress where Steve King voted to successfully override President Bush's veto. That was on June 18, 2008 during roll call 417. The Senate vote to override Bush's veto took place on the same day during Record Vote 151.

Steve King rants against the very law for which he voted, which the President of his political party vetoed, and which he, Steve King, voted to override. Steve King boils over at the costs of these Pigford II settlements, for which he voted, as being too costly.  That's ironic.  President George W. Bush vetoed the 2008 Farm Bill because many of its provisions were too costly. Then King voted to spend the money anyway! 

Like I said, it was a cerebral moment of cognitive disconnect.

NEXT UP: THE HOUSE CONSIDERS THE MIDDLE CLASS TAX CUTS BILL

H. Res. 1745 is the Rule providing for consideration of H. R. 4853, the Airport and Airway Extension Act of 2010, Part III. That's correct the Middle Class Tax Cut Bill is going back to the Senate as part of the Airport and Airway Extension Act. Suddenly the 111th Congress' lame duck session looks a lot less lame.

A brief history on H.R. 4853 shows us that the bill was introduced in the House on March 16th by Minnesota's Democratic Representative James Oberstar and passed by voice vote on March 17th. The bill made its way to the Senate where it was passed with an Amendment by Unanimous Consent on September 23rd.

North Dakota's Democratic Senator Byron Dorgan proposed Senate Amendment 4656 to H. R. 4853 for West Virginia's Democratic Senator John D. Rockefeller. The Amendment was in the nature of a substitute. The nature of H. R. 4853 was not changed by the Rockefeller Amendment.

The House Amendment provides for a Two year extension of alternative minimum tax relief; Permanent extension of marginal individual income tax rate reduction for middle-class taxpayers; Permanent reduced capital gains and dividend tax relief for middle-class taxpayers; Permanent extension of EGTRRA and ARRA improvements to child tax credit; Permanent extension of PEP and Pease relief for middle-class taxpayers; Permanent marriage penalty relief for middle-class taxpayers; Permanent earned income tax credit simplification and increase; Permanent extension of education tax incentives; Permanent extension of tax benefits for families and children; and Permanent extension of enhanced small business expensing.

Under this Amendment the threshold for the tax break will be the first $250,000 of earned income. Everyone who earns income will get a permanent tax cut on the first $250,000 of their income. If you report earned income more than $250,000 then you pay the increased tax rate only on the amount in excess of $250,000.

Most importantly this Amendment does not extend the Bush era FAT CAT TAX BOONDOGGLE.

Observations: Continuing Appropriations, That Miami Trip, PACs, & the FAT CAT TAX BOONDOGGLE

An Observation: Today marks the first test of the GOP' declared mandate from the voters to resist further spending. Tea Party demagoguery got the Grand Old Party into this mess. Watch the words from the Republican side of the aisle today as the House first considers H. Res. 1741, the closed rule advancing H .J. Res. 101which " Making further continuing appropriations for fiscal year 2011, and for other purposes. "

More on the Gula Graham managed trip to Miami. The Sunlight Foundation's Party Time is showing new Miami invites tying this trip to DOC PAC. DOC PAC is tied to Georgia Republican Tom Gingrey. It is a Republican Leadership PAC.

This group, although modest by most measures, is another example of why campaign finance is legalized money laundering. Money flows through these PACs providing levels of separation from giver to recipient. It appears that this gives the middle man "juice" or "vigorish" in currying favors. Why else would you need the filter?

This year DOC PAC was busy giving money to Republicans. This year's top recipient from DOC PAC is Georgia's Governor-elect Nathan Deal. DOC PAC gave him $8,600.

The link between the Member of Congress and their Leadership PAC isn't remote. Instead it looks like a vehicle for contributors to "double down" the way gamblers increase their wagers at the Blackjack Tables in casinos. Take DOC PAC and Gingrey for example. Gingrey's campaign committee reported that AFLAC, that insurance company known for its famous duck, was its number two contributor. $1,000 from individuals and $10,000 from the AFLAC PAC. Over at DOC PAC AFLAC came in at number one by giving $10,000 from its PAC.

Before you go duck hunting take a deeper look at Heavy Hitter AFLAC and you'll find they play both sides of the aisle. In Campaign 2010 AFLAC PAC spent $1,577,500, according to the Center for Responsive Politics' OpenSecrets.org. 52% went to Democrats and 48% to Republicans.

Another interesting aspect to AFLAC PAC is the source of funds. OpenSecrets.org describes a large contribution as anything over $200. AFLAC PAC takes eleven OpenSecret pages to list all of those contributors. Only three persons gave more than $1,000 to the PAC. It looks like the AFLAC associate base is well plugged into the PAC.

Compared to other PACs AFLAC PAC looks like one of the good guys. Take the PAC of Kansas' home grown tycoons Koch Industries to gain perspective. Where it took OpenSecrets.org eleven pages to list all of the "large" donors from AFLAC PAC it took them thirty pages to list similar donors to KOCHPAC. Where AFLAC PAC had three persons giving over $1,000 KOCHPAC had more than three pages listing persons who gave $1,000 or more to KOCHPAC.

Here they are, starting with those who gave $5,000. Here's another observation: If they can give KOCHPAC Five Grand they are probably among the folks who'll get that FAT CAT TAX BOONDOGGLE, especially these "homemakers" with that kind of surplus cash in their household budgets.

Nor can we forget Timothy Go of Andover, Kansas who gave $4,988 by giving six contributions in the amount of $833. Other KOCHPAC contributors gave multiple times, Mr. Go was just too obvious.

It seems to me that what the FAT CATS lose by paying their fair share of taxes can be easily offset by giving less to have corporations influence national policy. What doesn't make sense is borrowing $700 Billion to finance their piddly tax break, especially when their "homemakers" can write a check for Five Grand at the drop of a hat.
